| Registrierung Wir stellen Ihnen eine sichere Plattform zur Vergügung, die es Ihnen erlaubt, Schreibgeräte anzubieten. Wir dulden in keinster Weise irgenwelche illegalen Angebote oder Auktionen, die in betrügerischer Absicht eingestellt werden. Nachfolgend die Bedingungen, wenn Sie sich registrieren wollen. 1)Registrierung: Sie müssen 18 Jahre alt sein um sich registrieren zu dürfen. 2) Server: MartiniAuctions stellt nur die Plattform zur Verfügung. Wir sind in keinster Weise verantwortlich für die Aktivitäten der Verkäufer. Diese handeln eigenverantwortlich. Ebenso kontrollieren wir nicht die Qualität der angebotenen Ware, nehmen uns aber das Recht, sofern Ware angeboten wird, dessen Verkauf gegen deutsches Recht verstößt (Markenrechtsverletzungen o.ä.), diese Autionen zu löschen und die Verkäufer zu sperren. Die Benutzung der Server- Plattform geschieht auf Risiko des Nutzers. 3) Bieten und Verkaufen: Den registrierten Benutzern ist es gestattet, zu bieten und zu verkaufen. Als Bieter, mit Abgabe Ihres Gebotes, schließen Sie einen rechtsgültigen Vertrag mit dem Verkäufer. Prüfen Sie vor Abgabe des Gebotes, ob Sie die Ware auch wirklich ersteigern wollen. Als Verkäufer stellen Sie bitte sicher, das die von Ihnen angebotene Ware auch verfügbar ist. Bereits nach dem ersten erhaltenen Gebot, gehen Sie einen Vertrag mit dem Bieter ein. Wenn Die Auktion beendet ist und der Limitpreis erreicht wurde, sind Sie verpflichtet zu verkaufen. Sofern der Limitpreis nicht erreicht wurde, sind Sie von dieser Verpflichtung frei gestellt. Als Verkäufer dürfen Sie nicht auf Ihre eigenen Artikel bieten. Dieses ist ein Verstoß gegen die AGB`s und kann eine Sperrung zu Folge haben. 4) Angebotene Artikel: Als registrierter Benutzer ist es Ihnen erlaubt, Arikel einzustellen. Bitte beachten Sie, das es einige Arten Schreibgeräte gibt, die nicht eingestellt werden dürfen. Hierzu zählen z.B. solche, die nachträglich veredelt wurden. Dieses stellt eine Markenrechtsverletzung dar. Ebenso dürfen keine "fakes", also Schreibgeräte, welche einen Markennamen tragen, aber definitiv nicht aus dessen Produktion stammen, eingestellt werden. Sollten Sie im Einzelfall unsicher sein, fragen Sie uns bitte. 5) Gebühren: * Das Registrieren ist kostenlos, ebenso das Ersteigern von Ware. * Das Einstellen von Schreibgeräten kostet €0.10. Diese Gebühr ändert sich nicht, egal wie hoch der von Ihnen geforderte Einstiegspreis ist. * Weitere Kosten werden für Zusatzoptionen in Rechnung gestellt, hierbei ist es Ihnen frei gestellt, ob Sie diese in Anspruch nehmen. Die genauen Kosten entnehmen Sie bitte der Auktionsmaske. * Es wird eine Verkäuferabschlußgebühr in Rechnung gestellt. Datenschutz: Ihre email Adresse wird nur dem Gewinner Ihrer Auktion zur Verfügung gestellt. Ihre Registrierungsdaten bleiben in unserer Hand und werden nicht an Dritte weitergegeben. Haftung: Wir bieten diese Auktionsseite so an, wie Sie zu sehen ist, ohne Nutzungsarantie. Wir sind nicht verantwortlich für Serverausfälle oder für etwaige finanzielle Schäden, die hieraus resultieren könnten. As a bidder, take note, that placing a bid is a binding contract between you and the seller, and the bid cannot be retracted except because of a typographical or other error on the seller's part. If you place a bid, and win, you will be obligated to buy the product at the price you indicated as your bid. Placing a bid on this auction site, winning, then not paying for the product is illegal in most states, and prosecution can result . As a seller, the item that you place up for bids must be available. Once a bid has been placed for your item, you are in a binding contract with the potential buyer of the product, if that bid shall be the highest bid. Once the auction is over, if over reserve price, you are obligated to sell to the buyer who is the highest bidder. If, reserve price was not met, you are not obligated to sell the item. As a seller, you may not bid on your own items. 4. Posting Items: As a user, you are welcome to post items for sale on MartiniAuctions. We do have restrictions on what items you may sell, and what you may not sell. You may not sell illegal merchandise, like customized pens, fakes, eg. Items that are posted are subject to review by the staff of MartiniAuctions, and may be removed without prior notice, if considered to be in violation of the User Agreement. You may not include an email address, telephone number or website address in your posting. 5. Charges: * Registering are free on this server. * Buying is always free in MartiniAuctions. * Posting an item up for bid we do charge €0.10 per item * Additional sale features like "bold" "additional pictures" and other features: see cost in the auction mask. 6. Privacy: We gather your information so that people will have it on hand when they win your auction, or you win their auction. Personal information is not sold, rented, or used in any other way without your permission. Personal information sent to a user regarding a product bought or sold on the auction is not to be used for any other purpose, except for communication about the auction item. 7.
